What Must Be Disclosed When Selling Your HomeSellers need to be aware of what must be disclosed to be in compliance with disclosure laws. When you are deciding to sell a piece of real estate, there are certain things you must disclose about the property to the buyer before the sale can go through.

Disclosure laws are put in place to protect the buyer from unknowingly purchasing defective property. Not disclosing certain information about the property can jeopardize the sale, or worse, invite a lawsuit.

This has become more of an issue lately as some sellers are tempted to gloss over deficiencies in the home they are selling in order to try to get a higher sales price. In fact, a recent poll of real estate agents showed that 75% of agents ranked non-disclosure among the “top three current and future issues.”

What Must Be Disclosed

The main items that need to be disclosed are any defects with the home. This includes, but is not limited to, plumbing problems, water leaks, cracks in the foundation, insect infestations and toxic materials in the home — such as lead, asbestos, carbon monoxide or mold.

Be sure to fully disclose anything that may be pertinent to the buyer before purchase. Some disclosure laws include reporting issues with neighbors and whether the home has a criminal or notorious past.

If you are unsure about some information regarding your real estate, one option would be to state that you do not know that specific information. Remember though, if you knowingly withhold information, it may cause the sale to fall through or could be used against you in a lawsuit.

Does It Make Sense To Have A Pre-Inspection Done?

Sellers can also have their home inspected prior to placing the property on the market to prevent any surprises of unknown problems with the home. This way, defects can be fixed before listing the property, and the disclosure form can state the problem has been fixed. Buyers will almost surely want an inspection prior to closing, and a pre-inspection may suffice.

Be honest about any known issues with the property.

Disclosing information does not mean the seller needs to fix the problem. Any disclosed problems with the real estate can become a negotiation point.

Real estate disclosure laws may be different depending on the state in which you live. The best way to know what you need to disclose in your area is to check with your trusted real estate agent  and discuss any potential property issues with them before you fill out the seller disclosure form.

Scottsdale Quarter Hosts the AZ Wine & Dine Culinary Celebration

The Valley’s stars of the culinary scene will gather for a high-energy celebration of food and wine at the second annual AZ Wine & Dine, hosted by the Arizona Lodging & Tourism Association, to be held at the hip, urban setting of Scottsdale Quarter on April 4, 2013.

AZ Wine & Dine targets executive foodies and is designed to highlight the distinct variety of culinary outlets at Arizona hotels and resorts, as well as showcase several Scottsdale Quarter restaurants and a wide variety of wines and craft beers. Additionally, much of the proceeds benefit the educational efforts of the Arizona Lodging & Tourism Association.

The lush  setting of Scottsdale Quarter provides the perfect setting for attendees to experience culinary delights from hotel and resort participants including: The Phoenician, The Four Seasons Scottsdale at Troon North, Fairmont Scottsdale Princess, T. Cook’s at Royal Palms, Westin Kierland, Montelucia, TK’s Urban Tavern, District American Kitchen & Wine Bar and many more.

 Scottsdale Arts Festival is Not to Be MissedWow,  the high season here in Scottsdale has been flying by and we are about to come to one of the most exciting annual events that have come to define Scottsdale as one of the best places to live or visit…. the award-winning Scottsdale Arts Festival.

Named one of the top arts festivals in the nation by the readers of AmericanStyleMagazine and “Best Arts Festival” by Phoenix New Times, the Scottsdale Arts Festival features more than 200 jury-selected artists from throughout the United States and Canada.

Scottsdale is Renowned for its Devotion to the Arts

In a community renowned for its devotion to the arts, Scottsdale has an Arts Festival that rises above them all. Spend a beautiful afternoon between March 8th – March 10th and stroll through the Scottsdale Civic Center meeting and chatting with the artists. Have a taste of something new and different from the specialty food trucks, or get your favorite Taco to munch on while you are strolling.

This year the Scottsdale Arts Festival will be literally bubbling over with art and super-clean fun, with Baltimore artist Scott Pennington’s incredible Pink and Blue Dilemma: The Foam Incident.  Presented in collaboration with Scottsdale Public Art, this interactive art installation invites visitors to play with water-based soap suds that spill from a colorful factory as Pennington’s pink-and-blue-clad ‘technicians’ attempt to contain the flood of bubbles. Thirty-minute-long ‘foam incidents’ will occur five times a day throughout the Scottsdale Arts Festival.
